Sanjay YadavversusThe State of Bihar

Holding

The court held that provisional anticipatory bail may be granted subject to verification of the petitioner’s antecedent, with confirmation contingent on the number of prior cases.

Summary

The petitioner, Sanjay Yadav, sought anticipatory bail in a case registered under Section 30(a) of the Bihar Excise Act for alleged recovery of 126 litres of liquor from a motorcycle. He argued that he was not arrested at the spot, the seized vehicle was not his, and the case was based solely on secret information without proper investigation. The State opposed the bail. The High Court, considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs. 25,000 with two sureties and a condition that the trial court verify his criminal antecedent. The court stipulated that if the petitioner is found to have more than five prior excise cases, the bail would not be confirmed; if exactly five, it would be confirmed. The petitioner also undertook to deposit Rs. 5,000 with the Advocates’ Association within two weeks.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 482(2) of the Criminal Procedure Code in a case under Section 30(a) of the Bihar Excise Act.
  • Whether the existence of five prior cases under the Excise Act precludes the grant of anticipatory bail.
  • Whether reliance on secret information without a proper investigation justifies denial of anticipatory bail.
