The Court held that provisional anticipatory bail may be granted subject to conditions and verification of the petitioner’s antecedent.
Summary
Badal Kumar applied for anticipatory bail after the police alleged that 13.5 litres of liquor were recovered from an asbestos‑shaded room allegedly linked to him, invoking Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022. The petitioner asserted he has a clean antecedent, the liquor was not in his conscious possession, and the room does not belong to him, contending that the investigation was mechanical and based on unreliable information. The State opposed the bail, arguing the seriousness of the offence. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.500 with two sureties, subject to verification of the petitioner’s antecedent by the trial court. The order further stipulated that if any prior case is discovered, the provisional bail would not be confirmed; otherwise, it would be confirmed forthwith.
Issues considered
- Whether the petitioner is entitled to anticipatory bail under Section 438 of the Cr.P.C. and Section 482(2) of the Bihar Narcotic and S... Act in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
- Whether the alleged recovery of liquor establishes a case against the petitioner given the lack of conscious possession and ownership of the premises.
