Patna High Court

SOHAN PRASAD @ SOHAN KUMARversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court allowed the anticipatory bail application, granting bail to the petitioners under Section 482(2).

Summary

The petitioners, Sohan Prasad and Putul, applied for anticipatory bail after being named in an FIR for offences under Sections 115(2), 126(2), 109(1), 352 and 3(5) of the Bihar Negotiable Sale Act, 2023, stemming from an alleged assault on an informant on 4 March 2026. They argued that they have clean antecedents and that the informant, who is the brother and neighbour of the alleged victim Mohan, has falsely implicated them, describing the assault allegation as vague and omnibus. The State opposed the bail but could not refute the claim that the allegations were general and that the petitioners were not habitual offenders. The court examined the nature of the allegations, the petitioners' clean record, and the purpose of Section 482(2) to prevent abuse of the criminal process. Finding no substantive reason to deny bail, the court ordered that the petitioners be released on anticipatory bail upon furnishing a bail bond of Rs.10,000 with two sureties, subject to the trial court’s conditions. The application for anticipatory bail was therefore allowed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 482(2) of the Bihar Negotiable Sale Act, 2023 in view of the allegations.
  • Whether the allegations in the FIR are specific enough to justify denial of bail.
  • Whether the petitioners are falsely implicated and have a clean antecedent warranting bail.

                                3. Learned counsel for the petitioners submits that

petitioners are persons with clean antecedent and the informant

alleges that on 04.03.2026 at 3:00 PM, he came out of his house

when Mohan started abusing him, accordingly he came back
