Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was refused.

Summary

The petitioner, Prince Kumar, was accused of raping a minor girl, recording the act, and threatening to disseminate the video, leading to the victim's suicide. The allegations arise under Sections 64, 108, 61(2) of the Bharatiya Nyaya Sanhita, Sections 4 and 17 of the POCSO Act, and Sections 67 and 67A of the IT Act. The petitioner claimed innocence, alleging false implication due to a personal relationship with the deceased. The court examined the seriousness of the charges and the material on record. Considering the gravity of the offences and the evidence, the court refused the petitioner's request for anticipatory bail. The petition for anticipatory bail was therefore dismissed.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner in view of the serious allegations under the Bharatiya Nyaya Sanhita, POCSO Act and IT Act

                                 2. Petitioner apprehends arrest in Chhaurandano P. S.

Case No. 151 of 2025 registered for the offences punishable
