The Court ordered provisional anticipatory bail for the petitioners, subject to bond, sureties, and verification of criminal antecedents, with confirmation contingent on the verification outcome.
Summary
The petitioners, three residents of Saran district, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly recovering 200 litres of liquor from a Toto. They contended that they were not arrested on the spot, had no possession of the liquor, were not owners of the seized vehicle, and were implicated solely on a confessional statement of another accused made in police custody, which they argued lacks evidentiary value. The State opposed the bail application. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on each petitioner furnishing a bail bond of Rs.30,000 with two sureties and subject to verification of their criminal antecedents. The order stipulated that if any petitioner’s antecedent exceeds the numbers disclosed (more than three, six, or two cases respectively), the bail would not be confirmed; otherwise, the provisional bail would be confirmed. The decision rests on the principles of anticipatory bail under Section 482(2) of the CrPC and the lack of direct evidence linking the petitioners to the alleged offence.
Issues considered
- Whether anticipatory bail should be granted to the petitioners under Section 30(a) of the Bihar Prohibition and Excise Act given the nature of the evidence and their criminal antecedents.
