Patna High Court

Pancham Rai @ Panchan Rai @ Pancham RayversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner.

Summary

The petitioner, Pancham Rai, was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act for alleged possession of 15 litres of illicit country-made liquor recovered from a public place. He contended that he was falsely implicated, no liquor was found in his personal possession, and the recovery was from an open area accessible to the public. The State opposed bail, citing the seriousness of the offence and the petitioner’s two prior criminal antecedents. The court noted the lack of direct incriminating evidence against the petitioner and the absence of compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. Considering these factors and the period of custody already endured, the court granted bail on condition of a Rs.15,000 bond with two sureties.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act in view of the facts of the case.
  • Whether non‑compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, warrants denial of bail.
