Patna High Court

Ankit DhangarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Ankit Dhangar, sought regular bail in a case (Paharpur PS Case No. 292 of 2025) involving alleged murder by throttling, with charges under sections 80, 61(2) and 3(5) of the B.N.S. The FIR described a telephonic tip about the death of the deceased’s daughter, leading to the discovery of a dead body with a neck mark. The petitioner, the brother‑in‑law of the deceased, claimed he was falsely implicated and had no prior criminal record, having been in judicial custody since 9 June 2025. The State opposed bail. After hearing both sides, the court found the allegations to be general and omnibus, and, considering the petitioner’s lack of antecedents, ordered his release on bail upon furnishing a bond of Rs 10,000 with two sureties. The bail was granted subject to the satisfaction of the learned ACJM‑IX, East Champaran.

Issues considered

  • Whether the petitioner is entitled to regular bail despite charges under sections 80, 61(2) and 3(5) of the B.N.S.
  • Whether the allegations against the petitioner constitute sufficient ground to deny bail
  • Whether the petitioner’s lack of criminal antecedents and claim of false implication warrant bail
