Patna High Court

Sanjay YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a Rs.30,000 bond and verification of his criminal antecedents.

Summary

The petitioner, Sanjay Yadav, was implicated in a case concerning the seizure of 77.76 litres of illicit liquor under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. He argued that no liquor was found in his possession and that his name was mentioned only through hostile co‑accused disclosures, asserting a clean criminal record. The State opposed his bail application. The Court considered the bail provisions under the B.N.S.S., 2023, particularly Section 2(1)(d) and Section 482(2), and directed that bail be granted on a bond of Rs.30,000, subject to verification of any concealed criminal antecedents. The trial court was instructed to verify his antecedents and cancel bail if concealment is discovered. Consequently, the petitioner was released on bail pending trial.

Issues considered

  • Whether the petitioner is entitled to bail under the B.N.S.S., 2023 in a case under the Bihar Prohibition and Excise (Amendment) Act, 2018
  • Whether the petitioner’s alleged involvement, based solely on co‑accused statements, justifies denial of bail
