BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner, subject to a bail bond, sureties and conditions under Section 482 of the B.N.S.S., 2023.

Summary

The petitioner, Kuresh Singh, sought anticipatory bail fearing arrest in a case registered under Sections 80(1), 238(a) and 3(5) of the B.N.S. relating to the dowry‑related murder of his sister‑in‑law. The prosecution alleged that the deceased’s husband and co‑accused had harassed and eventually killed her. The petitioner, being the brother‑in‑law, claimed he had no involvement in the family dispute or the crime. The State opposed the bail, arguing the seriousness of the offences. Considering the facts, the court ordered that the petitioner be released on anticipatory bail if arrested within eight weeks, upon furnishing a bail bond of Rs. 10,000 with two sureties, subject to conditions under Section 482 of the B.N.S.S., 2023.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 80(1) of the B.N.S.
  • Whether the nature of the offences under Sections 238(a) and 3(5) B.N.S. justifies denial of bail
  • Whether the petitioner is likely to tamper with evidence or influence witnesses
