Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted as the seizure was not shown to be in the petitioner's conscious possession and he had a clean antecedent.

Summary

The petitioner, Brijesh Sahani, was named in an FIR under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly engaging in the illegal manufacture and trade of liquor, with 138.66 litres of illicit liquor seized near a river bank. The petitioner contended that the seizure was made in a public open area, that he was not present at the spot, and that the liquor was not in his conscious possession; he also challenged the reliability of the seizure list, which relied solely on police testimony. The Additional Public Prosecutor opposed the grant of anticipatory bail. The Court examined the factual submissions and noted that the recovery did not appear to be from the petitioner's physical possession and that he had a clean antecedent. Relying on these observations, the Court directed that the petitioner be released on anticipatory bail upon surrendering within four weeks, furnishing a bail bond of Rs.10,000 with two sureties, and complying with conditions under Section 438(2) of the CrPC and Section 482(2) of the BNSS. The order thus granted bail subject to the stipulated conditions.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 of the CrPC in view of the alleged seizure of illicit liquor.
  • Whether the seizure of liquor can be said to be in the conscious possession of the petitioner.
