Holding
The court granted regular bail to the petitioner.
Summary
Bhola Sahani was arrested after police recovered 97.1 litres of wine and beer from his residence and was charged under Sections 30(a) and 37 of the Bihar Prohibition and Excise Act. The petitioner contended that the liquor belonged to a joint house, he had no involvement in the alleged wine business, and he possessed a clean antecedent, having been in judicial custody since 23‑04‑2026. The State opposed his bail, but the court noted the absence of an independent witness to the seizure and the petitioner's clean record. Considering these factors, the court deemed the petitioner eligible for regular bail. Accordingly, the court ordered his release on bail of Rs.10,000 with two sureties of the same amount.
Issues considered
- Whether the petitioner is entitled to regular bail under Sections 30(a) and 37 of the Bihar Prohibition and Excise Act given the facts of the case
- Whether the lack of an independent witness to the seizure and the petitioner's clean antecedent justify granting bail
