Patna High Court

Ajay Kamat @ Bhola KamatversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court inclined to grant bail to the petitioner, subject to specified conditions and a cash bond.

Summary

The petitioner, Ajay Kamat, was arrested in connection with the recovery of 630 litres of illicit Nepali liquor and charged under IPC Sections 272, 273 read with 34 and Section 30(a) of the Bihar Prohibition and Excise Act. He contended that he was falsely implicated, that no contraband was found in his possession, and that he had no link to the vehicle from which the liquor was seized, despite having six prior criminal cases and being in custody since 18‑12‑2025. The State opposed bail, while the petitioner’s counsel highlighted the lack of compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The Court, after considering the facts and the period of custody, decided to grant bail subject to a cash bond of Rs.15,000 with two sureties and several conditions regarding appearance, travel, and future conduct. The order directs the petitioner to be released on bail after framing of charge, if not already done.

Issues considered

  • Whether bail should be granted to the petitioner despite the seriousness of the offences and his prior criminal antecedents.
  • Whether the procedural requirements under Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023 have been complied with.
  • Whether the petitioner’s alleged lack of connection to the seized liquor and vehicle warrants bail.
