Patna High Court

Trilok Chandra Thakur @ Triloki ThakurversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was denied as the petitioner’s identification by the victim and his criminal antecedents warranted refusal.

Summary

The petitioner, Trilok Chandra Thakur, applied for anticipatory bail after being implicated in a case of alleged robbery and assault under several sections of the Bharatiya Nyaya Sanhita. The FIR alleges that he, along with others, looted cash and a gold chain from the informant's son and assaulted him with a lathi, danda, and pistol butt, causing injuries. The petitioner claimed innocence, arguing that the allegations were vague and omnibus. The State opposed bail, contending that the crime was a road robbery, the victim positively identified the petitioner, and he has two prior criminal convictions. Considering the seriousness of the offences, the identification by the victim, and the petitioner’s criminal antecedents, the court refused the anticipatory bail application.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in view of the alleged offences under the Bharatiya Nyaya Sanhita.
  • Whether the petitioner’s prior criminal antecedents and identification by the victim justify denial of bail.
