Provisional anticipatory bail is granted to the petitioner subject to bond, sureties, verification of antecedent, and a deposit with the Advocates’ Association.
Summary
Petitioner Karu Miyan sought anticipatory bail after a FIR was lodged under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 alleging recovery of 85 litres of liquor and 1,000 litres of Mahua jaggery from a bamboo orchard not owned by him. He asserted a clean antecedent and argued that nothing was found in his possession and the alleged site was accessible to villagers, raising doubts about the prosecution’s case. The State opposed the bail. The Patna High Court, considering these submissions, granted provisional anticipatory bail on a bond of Rs.500 with two sureties, subject to verification of his antecedent under Section 482(2) of the Code of Criminal Procedure and a further deposit of Rs.1,500 with the Advocates’ Association. The order stipulated that if any antecedent is discovered, the bail would be revoked; otherwise, it would be confirmed. The application was allowed.
Issues considered
- Whether anticipatory bail should be granted in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
- Whether the petitioner’s clean antecedent and lack of possession of the alleged contraband justify bail.
- Whether the conditions imposed under Section 482(2) of the CrPC are appropriate.
