Bharat Kumar @ Bharat PaswanversusThe State of Bihar

Holding

The Court conditionally granted provisional anticipatory bail, subject to bond, sureties, and verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Bharat Kumar, feared arrest in a case registered under Section 111 of the B.N.S. and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of 270 litres of liquor from a vehicle. He argued that he was not arrested on the spot, had no conscious possession of the liquor, was not the vehicle's owner, and was implicated solely on a confessional statement made by Shiv Shankar Kumar while in police custody, which he claimed lacked evidentiary value. The State opposed his application for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.20,000 with two sureties, subject to verification of his criminal antecedent. If the verification shows more than four prior cases, the bail will not be confirmed; if only four, the bail will be confirmed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438(2) of the Cr.P.C. in view of the alleged offences and his criminal antecedent.
