Holding

The Court granted provisional anticipatory bail subject to conditions and verification of the petitioner’s antecedent cases.

Summary

The petitioner, Aman Kumar, applied for anticipatory bail after a case was registered against him under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of 311.540 litres of liquor from his premises. He argued that he was not arrested, no liquor was found in his possession, the alleged site was a cement godown, and the only evidence was a confessional statement of a co‑accused made while in police custody, which he claimed lacks evidentiary value. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.5,000 with two sureties and conditioned the order on verification of the petitioner’s criminal antecedents. If more than one prior case is found, the bail will not be confirmed; if only one antecedent is found, the bail will be confirmed. The order was made under Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S.

Issues considered

  • Whether anticipatory bail can be granted in a case under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether a confessional statement made by a co‑accused in police custody can be the basis to deny anticipatory bail.
  • Whether the petitioner’s prior criminal antecedents affect the confirmation of the provisional anticipatory bail.

                                2. The petitioner apprehends his arrest in a case

registered for the offences punishable under Sections 30(a) and

32(3) of the Bihar Prohibition and Excise (Amendment) Act,

                   2022.

                                3. Learned counsel for the petitioner submits that

petitioner has antecedent of one case and allegation is of

                                4. Learned counsel for the petitioner submits that

petitioner was not arrested from the spot, as such, nothing was

recovered from his conscious possession and the place from

would create evidence against himself and, hence, would get

implicated. It is next submitted that petitioner came to be

implicated based on the confessional statement of Ajit in police

custody which does not have any evidentiary value in the eye of

          law.

                       5. Learned A.P.P. for the State opposes the prayer for

          anticipatory bail of the petitioner.

anticipatory bail on furnishing bail bonds of Rs.5,000/- (Rupees
