The Court provisionally granted anticipatory bail subject to conditions and verification of the petitioner’s criminal antecedent.

Summary

Petitioner Sachit Kumar Yadav applied for anticipatory bail fearing arrest in a case registered under Sections 274 and 275 of the Bihar Narcotic Substances Act and Section 30(a) of the Bihar Prohibition and Excise Act, 2016, alleging that 495 litres of liquor were recovered from a car he allegedly owned. The petitioner claimed he had a clean antecedent, was not in possession of the seized liquor at the time of arrest, and was not the owner of the vehicle, with no documentary proof of transfer. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties and conditions under Section 438(2) of the Cr.P.C. and Section 482(2) of the Bihar Narcotic Substances Act, pending verification of the petitioner’s criminal antecedent. The order stipulates that if any antecedent is found, the bail will not be confirmed; otherwise, it will be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner under Section 438 Cr.P.C. and Section 482(2) of the Bihar Narcotic Substances Act in view of the alleged liquor seizure and ownership dispute.
  • Whether the petitioner’s alleged clean antecedent and lack of possession of the seized liquor justify the grant of anticipatory bail.

petitioner was not arrested from the spot, as such, nothing was

recovered from his conscious possession. It is further submitted

that petitioner is not the owner of the seized vehicle and came to
