Bachcha Yadav @ Vivek KumarversusThe State of Bihar

Holding

The Court granted provisional anticipatory bail subject to conditions and verification of antecedents under Section 482(2) of the B.N.S.S.

Summary

The petitioner, Bachcha Yadav, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, alleging that the alleged recovery of 384.660 litres of liquor was from a location not belonging to him and that the only evidence was a confessional statement made in police custody. He argued that no liquor was found in his possession and that the police investigation was mechanically based on statements without proper inquiry. The State opposed the bail, contending that the allegations warranted detention. The Court, applying Section 482(2) of the B.N.S.S., granted provisional anticipatory bail conditioned on a bail bond of Rs.5,000 with two sureties and directed verification of the petitioner’s criminal antecedents. If more than one prior case is found, the bail would not be confirmed; if only one prior case, the bail would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act.
  • Whether the confessional statement made in police custody has evidentiary value sufficient to deny bail.
  • Whether the police investigation was adequate to justify denial of anticipatory bail.
