The Court granted provisional anticipatory bail subject to bond, sureties and verification of the petitioner’s antecedent.

Summary

Guddu Kumar, a resident of Saran district, applied for anticipatory bail fearing arrest in a case registered under Section 317(5) of the IBNS and Sections 30(a), 34 and 36 of the Bihar Prohibition and Excise (Amendment) Act, 2022 for allegedly recovering 1,176 litres of spirit from a pick‑up vehicle. The petitioner argued that he was not arrested on the spot, had no possession of the seized vehicle, was not its owner, and that the case was based solely on confessional statements of co‑accused Amit and Dinesh made in police custody, which lack evidentiary value. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties, and conditioned the order on verification of the petitioner’s criminal antecedent by the trial court. If any antecedent is found, the bail will not be confirmed; if the petitioner is found to have a clean record, the bail will be confirmed.

Issues considered

  • Whether anticipatory bail should be granted in view of the alleged possession of a large quantity of spirit and the nature of the offences.
  • Whether confessional statements made by co‑accused in police custody can be relied upon to deny anticipatory bail.
  • Whether the petitioner’s criminal antecedent, if any, should affect the confirmation of anticipatory bail.

                                 3. Learned counsel for the petitioner submits that

petitioner is a person with clean antecedent and allegation is of

recovery of 1176 litres of spirit from a Pick-Up Vehicle.

                                 4. Learned counsel for the petitioner submits that

petitioner was not arrested from the spot, as such, nothing was

implicated based on the confessional statement of Amit and Dinesh
