Mithun Choudhary @ Mithun ChaudharyversusThe State of Bihar

Holding

The Court provisionally granted anticipatory bail, subject to bond, sureties, and verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Mithun Choudhary, sought anticipatory bail after learning that he might be arrested in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of five litres of liquor from a field not owned by him. He argued that the police had mechanically implicated him based on a chaukidar’s complaint, without any seizure from his conscious possession, and highlighted his antecedent of seven prior excise cases. The State opposed the bail, contending that the allegations warranted detention. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bond of Rs.35,000 with two sureties and subject to verification of the petitioner’s criminal antecedent. It directed that if the verification shows more than seven prior cases, the bail would not be confirmed; if exactly seven, the bail would be confirmed. The order was made under Section 438(2) of the Criminal Procedure Code and Section 482(2) of the Bihar Narcotic Substances Act.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438 CrPC in the context of an excise offence under the Bihar Prohibition and Excise Act
  • Whether the petitioner’s antecedent of seven prior cases warrants denial of bail

petitioner was not arrested from the spot, as such, nothing was

recovered from his conscious possession and even the alleged

recovery is from a field which does not belong to the petitioner
