Patna High Court

Sanjay PoddarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that bail should be granted to the petitioner.

Summary

The petitioner, Sanjay Poddar, was arrested in connection with a case arising from a cattle grazing dispute that allegedly led to assault with an iron rod and brick pelting, causing injuries to several villagers. He was charged under Sections 126(2), 115(2), 109, 74, 303(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023. The petitioner claimed he was falsely implicated due to village rivalry and that the injuries were simple in nature, also noting a single prior criminal antecedent. The State opposed bail, arguing the seriousness of the offences. Considering the custody period, submission of the charge sheet, and the circumstances, the Court granted bail on condition of a Rs.15,000 bond with two sureties.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the offences under the Bharatiya Nyaya Sanhita, 2023
  • Whether the petitioner’s prior criminal antecedent and the alleged injuries preclude bail

persons, including the petitioner, assaulted the informant and his

family members. It is alleged that petitioner along with other co-

accused assaulted Ashok Sah and Shambhu Sah on their heads

further alleged that petitioner also participated in pelting bricks

from the roof, causing injuries to the villagers who came to
