Patna High Court

Chintu KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that, on a prima facie basis, the FIR indicated false implication and delay, and therefore granted bail to the petitioner.

Summary

The petitioner, Chintu Kumar, was named in an FIR under Sections 115(2), 126(2), 69, 351(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 for allegedly having a physical relationship with an informant under the false pretext of marriage. The petitioner contended that the relationship had existed for two years, that a marriage could not be solemnised due to an altercation between the informant and his mother on 5 March 2026, and that the FIR was lodged on 26 April 2026, a delay of one month and twenty days, suggesting an after‑thought false implication. The State opposed bail, asserting the specificity of the allegations. The Court examined the delay and the prima‑facie suggestion of false implication and, applying Section 438(2) of the CrPC and Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita, 2023, ordered the petitioner’s release on bail with a bond of Rs.10,000 and two sureties. The bail was conditioned on compliance with the statutory provisions.

Issues considered

  • Whether the delay in filing the FIR and the circumstances alleged amount to a prima facie false implication warranting bail
  • Whether the petitioner is entitled to bail under Section 438(2) of the CrPC and Section 482(2) of the BNSS

petitioner for the last two years. It is also submitted that the

petitioner was always ready to solemnize marriage with the

informant, but as informant entered into an altercation with

mother petitioner on 05.03.2026 at about 8:00 P.M, the

mother of petitioner refused to solemnize marriage. It is also

submitted that last allegation of physical relationship as per

which is the altercation as mentioned in FIR with mother of

the petitioner i.e. on 5.03.2026, this FIR was lodged on

26.04.2026 i.e. only with an inordinate delay of one month
