Holding
Since the alleged transactions predate any employer‑employee relationship, the accusations are not convincingly established and bail is granted.
Summary
The petitioners, Md. Shahid Parvej and Md. Nabil Shahid, were charged under Sections 318(4) and 316(4) of the Bhartiya Nyaya Sanhita, 2023 for allegedly misappropriating Rs. 10 lakh from an informant’s shop by diverting payments through PhonePe and Paytm. They contended that the alleged transactions occurred before the shop’s inauguration on 26‑10‑2024, when no employer‑employee relationship existed between them and the informant, rendering the accusations implausible. The learned Additional Public Prosecutor opposed bail, arguing the offences were cognizable. The court examined the timeline and the relevance of the employer‑employee relationship to the alleged offences. Finding the allegations not convincingly established, the court directed that the petitioners be released on bail if arrested or surrendered within four weeks, subject to a bond of Rs.10,000 each with two sureties and conditions under CrPC Section 438(2) and BNS Section 482(2).
Issues considered
- The alleged misappropriation falls within Sections 318(4) and 316(4) of the Bhartiya Nyaya Sanhita, 2023 given the factual timeline.
- Whether bail should be granted to the petitioners despite the charges.
- The relevance of the employer‑employee relationship to the commission of the alleged offences.

informant while working as a staff against the sale of shoe
related items to the wholesaler and other small shopkeepers
and directly diverted their payment to their bank account by
using PhonePe and Paytm.
4. It is submitted by learned counsel appearing on
behalf of petitioners that admittedly the relationship between
informant and petitioners is of employer and employee. It is
submitted that the shop of the informant was admittedly
inaugurated on 26.10.2024, the date on which the
relationship of employer and employee came into existence,
but the screenshot as provided by the informant qua
misappropriated amount suggests that all alleged payment
as made through PhonePe and Paytm, was made before
26.10.2024, when there was no relationship of employer
and employee as between the informant and petitioners and,
therefore, all such allegations prima facie appears not
convincing and due to oblique motive just for false
implication of these petitioners, present case was lodged.
Petitioners claimed clean antecedent.
5. Learned APP opposed the prayer of bail.
