The Court provisionally granted anticipatory bail to the petitioner, subject to bond, sureties, and verification of his criminal antecedent.

Summary

The petitioner, Mithilesh Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018, where liquor and a motorcycle were seized from other individuals. He argued that he had no direct possession of the liquor and was implicated only because he owned the seized vehicle, asserting a clean criminal record. The State opposed the bail, contending the ownership linked him to the offence. The Court, after considering the submissions, granted provisional anticipatory bail subject to a Rs.500 bond, two sureties, and verification of the petitioner’s antecedent by the trial court. It stipulated that if any prior case is found, the bail would not be confirmed; otherwise, it would be confirmed immediately.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner under Section 438 of the Cr.P.C. despite alleged involvement in a liquor seizure case under the Bihar Prohibition and Excise Act.
  • Whether ownership of a vehicle used in the alleged offence is sufficient ground for arrest and denial of bail.

                                3. Learned counsel for the petitioner submits that

petitioner is a person with clean antecedent and allegation is of

petitioner was not arrested from the spot, as such, nothing was

person would use his own vehicle for committing an occurrence

and, thus, would create evidence against himself and, hence,

would get implicated. It is also submitted that petitioner was

                       5. Learned A.P.P. for the State opposes the prayer for

          anticipatory bail of the petitioner.

                       6. Considering the submissions made by the learned

                       7. However, it is made clear that thereafter the learned

Trial Court shall verify the criminal antecedent of the petitioner

and if it is found that petitioner has antecedent of even one case,

it would be presumed that petitioner had concealed his

antecedent before this Court at para 3 of the anticipatory bail
