Patna High Court

Dildar KhanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to conditions under Section 480(3) of the B.N.S.S.

Summary

The petitioner, Dildar Khan, a driver, was arrested for allegedly transporting 259.2 litres of illicit foreign liquor in the dickey of a vehicle, contravening Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. He claimed innocence, asserting that the liquor was placed without his knowledge, he did not own the vehicle, and he has a clean antecedent. The State opposed bail, while the petitioner’s counsel highlighted the lack of conscious possession, non‑compliance of Section 103 of the B.N.S.S., 2023, and the petitioner’s custody since 19‑05‑2026. The court, considering the petitioner’s clean record, short custody period, and the nature of the recovery, ordered his release on bail with a bond of Rs.10,000 and two sureties, subject to conditions under Section 480(3) of the B.N.S.S. and other stipulations. The bail order required a close relative as one bailor and attendance at all court dates, with cancellation provisions for non‑compliance.

Issues considered

  • Whether the petitioner is entitled to bail despite the alleged possession of illicit liquor under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
  • Whether the alleged non‑compliance of Section 103 of the B.N.S.S., 2023, bars the grant of bail.
  • Whether the petitioner’s clean antecedent and period of custody justify bail.
