Patna High Court

Sonu KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the recovery of illicit liquor was not prima facie made from the petitioner's possession and therefore granted anticipatory bail.

Summary

The petitioner, Sonu Kumar, was named in an FIR for alleged illegal manufacture and trade of illicit liquor under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, with 55 litres of liquor reportedly recovered from his cow yard. He contended that the liquor was not in his conscious possession, that the seizure list lacked independent witnesses, and that the premises were open to the public. The Additional Public Prosecutor opposed his request for anticipatory bail. The court examined whether the seizure amounted to prima facie possession and whether there was sufficient material to deny bail. Finding that the recovery did not clearly establish the petitioner's possession, the court granted anticipatory bail, directing release on a bond of Rs.10,000 with two sureties, subject to conditions under Section 438(2) of the CrPC and Section 482(2) of the BNSS.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under the circumstances.
  • Whether the seizure of illicit liquor constitutes prima facie possession by the petitioner.
  • Whether the material on record justifies denial of bail.
