The court granted bail to the petitioner with conditions.
Summary
Gautam Kumar was arrested after police stopped his e‑rickshaw and discovered 35.670 litres of illicit foreign liquor hidden in a secret compartment. He claimed he had no knowledge of the liquor, that the seizure violated mandatory search procedures, and that he had clean antecedents. The State opposed his bail, citing the alleged offences under Sections 30(a) and 47 of the Bihar Prohibition & Excise Act. The court, considering the nature of the recovery, the petitioner’s custody period, and his clean record, granted bail subject to a Rs.10,000 bond, two sureties, and conditions under Section 480(3) of the BNSS. The bail order required the petitioner’s presence at all court dates and stipulated cancellation if conditions were breached.
Issues considered
- Whether bail should be granted to the petitioner accused under Sections 30(a) and 47 of the Bihar Prohibition & Excise Act
