Patna High Court

RANJEET PASWAN @ RANJIT PASWANversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner, subject to bond and surety conditions.

Summary

Ranjeet Paswan applied for anticipatory bail after learning that a case had been registered against him under Section 30(a) of the Bihar Prohibition and Excise Act for the alleged recovery of 250 litres of illicit liquor from a forest area. The prosecution alleged his involvement, but no incriminating material was found in his possession and he asserted a clean antecedent. The State opposed the bail, arguing the seriousness of the offence. The Court considered the nature of the accusation, the location of the recovery, and the petitioner's clean record, and decided to grant anticipatory bail. The order directed that if arrested or surrendered within eight weeks, the petitioner could be released on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.
