Anticipatory bail is granted to the petitioner subject to bail bond and surety conditions.
Summary
The petitioner, Ranjeet Rai, sought anticipatory bail after being implicated in a case under Section 30(a) of the Bihar Prohibition and Excise Act for alleged possession of 15 litres of illicit liquor seized from a motorcycle. The prosecution alleged the liquor was recovered from the vehicle, but the petitioner asserted he was neither the driver nor the owner and that no incriminating material was found in his possession. He also highlighted his clean antecedent. The court examined these facts, noting the lack of direct involvement and the suspicion basis of the accusation. Considering the circumstances, the court granted anticipatory bail, directing that if arrested within eight weeks, the petitioner must furnish a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.
