Patna High Court

Subhash KumarversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was denied because the petitioner’s ownership of the seized motorcycle established sufficient suspicion to justify refusal of bail.

Summary

The petitioner, Subhash Kumar, the registered owner of a motorcycle from which 51.840 litres of illicit liquor was seized, sought anticipatory bail in a case under Section 317(5) of the Bharatiya Nyaya Sanhita and Section 30(a) of the Bihar Prohibition and Excise Act. The prosecution alleged the liquor was recovered from the seized vehicle, implicating the petitioner. The petitioner argued that no incriminating material was found in his conscious possession and that he was being accused merely on suspicion, asserting a clean antecedent. The State opposed the bail, emphasizing the petitioner’s ownership of the vehicle used in the alleged offence. The Court considered that ownership of the seized motorcycle established a sufficient nexus to the offence and that mere suspicion was not a ground to grant anticipatory bail. Consequently, the Court refused the petitioner's prayer for anticipatory bail.

Issues considered

  • Whether anticipatory bail can be granted when the petitioner is the registered owner of a vehicle from which illicit liquor was seized.
  • Whether the absence of incriminating material in the petitioner's conscious possession negates the basis for anticipatory bail.
  • Whether mere suspicion based on ownership suffices to deny anticipatory bail under the relevant statutes.
