Patna High Court

Jitan SadaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a bond and sureties under Section 480(3) of the Bharatiya Nyaya Sanhita.

Summary

The petitioner, Jitan Sada, was arrested in connection with a case registered under multiple sections of the Bharatiya Nyaya Sanhita for allegedly assaulting members of an informant's family with deadly weapons. He had been in custody since 12 April 2025. Counsel for the petitioner argued that the specific assault allegations pertained to other co‑accused, that one co‑accused had already been granted bail, and that the investigation was complete, eliminating any risk of evidence tampering. The State opposed the bail application. The court, noting that the allegations were general and that the petitioner had been detained for an extended period, ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to the conditions of Section 480(3) of the Bharatiya Nyaya Sanhita.

Issues considered

  • Whether the petitioner is entitled to bail despite the seriousness of the offences alleged under the Bharatiya Nyaya Sanhita.
  • Whether there is a risk of tampering with evidence or influencing the investigation if bail is granted.
