Holding

The Court granted provisional anticipatory bail subject to bail bond conditions and verification of antecedents, with confirmation contingent on the number of prior cases.

Summary

Akshay Singh applied for anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act, alleging that liquor was recovered from a location adjacent to his house and not from his possession. He claimed the police implicated him mechanically, relying on a hostile chowkidar, and highlighted his two prior excise cases. The State opposed the bail. The High Court, considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.10,000 with two sureties and directed the trial court to verify his criminal antecedents. If more than two prior cases are found, the bail will not be confirmed; if exactly two, it will be confirmed. The order was made under Section 482(2) of the B.N.S.S.

Issues considered

  • Whether anticipatory bail should be granted in a case under Section 30(a) of the Bihar Prohibition and Excise Act given the petitioner’s prior criminal antecedents
  • Whether the police investigation was sufficient to justify arrest
