Provisional anticipatory bail is granted subject to bail bond, sureties and verification of the petitioner’s antecedents, with confirmation contingent on the number of prior cases.

Summary

The petitioner, Vijay Singh, sought anticipatory bail fearing arrest in a case under Sections 30(a), 41 and 47 of the Bihar Prohibition and Excise Act, alleging that liquor was recovered from four vehicles but none was found in his possession and he is not the owner of the vehicles. He claimed the case was mechanically filed based on a hostile chowkidar’s information and that he has five prior excise cases. The State opposed the bail. The Court granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.25,000 with two sureties and that the trial court verify his criminal antecedents. If more than five prior cases are found, the bail will not be confirmed; if exactly five are found, the bail will be confirmed. The order is subject to Section 482(2) of the Bihar Narcotic and Smuggling Act.
