Holding
The Court granted provisional anticipatory bail subject to verification of the petitioner’s criminal antecedent.
Summary
The petitioner, Lalbabu Kumar, sought anticipatory bail fearing arrest in a case involving alleged offences under Sections 317(5), 111 and 61(2) of the Bihar Narcotic Substances Act and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022. He contended that he was not caught in possession of liquor, did not own the seized vehicles, and was implicated solely on a confessional statement of a co‑accused made while in police custody, which he argued lacks evidentiary value. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.15,000 with two sureties and directed the trial court to verify the petitioner’s criminal antecedent. If the antecedent exceeds three cases, the bail will not be confirmed; if it is exactly three, the bail will be confirmed. The order was made under Section 438(2) of the Cr.P.C. and Section 482(2) of the Bihar Narcotic Substances Act.
Issues considered
- Whether anticipatory bail can be granted in a case involving alleged excise and narcotic offences.
- Whether a confessional statement of a co‑accused made in police custody can form the basis for implicating the petitioner.
- Whether the petitioner’s lack of possession and ownership of the seized vehicles precludes arrest.
