Holding
Provisional anticipatory bail is granted to the petitioner, subject to verification of his criminal antecedent.
Summary
The petitioner, Nagendra Bin, sought anticipatory bail after the police alleged his involvement in the illegal possession of 50.5 litres of liquor seized from Yogendra Bin and Om Prakash Ram under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022. The petitioner argued he had a clean criminal record and was not in direct possession of the liquor, contending that the case against him was based solely on a confessional statement of an arrested co‑accused. The State opposed the bail, asserting the seriousness of the offence. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.500 with two sureties and directed verification of the petitioner’s antecedent. It stipulated that if any prior case is found, the bail would not be confirmed; otherwise, the provisional order would be confirmed. The order was made under Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S.
Issues considered
- Whether the petitioner is entitled to anticipatory bail under Section 438 of the Cr.P.C.
- Whether the alleged involvement based on a co‑accused’s confessional statement suffices to deny bail
- Whether the petitioner’s criminal antecedent affects the grant of anticipatory bail
