Patna High Court

Rajesh @ Rajesh YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail be granted to the petitioner on furnishing a bond of Rs.10,000 with two sureties and subject to prescribed conditions.

Summary

Petitioner Rajesh Yadav was arrested on 23 March 2026 in connection with Maheshkhunt police case No.48, charged under several sections of the Bihar Non‑Specific (BNS) Act and Section 27 of the Arms Act. The prosecution alleged that he, along with others, participated in assaulting the informant's husband and that a co‑accused fired a pistol. The petitioner argued that the FIR contains no specific allegation of an overt act against him, he has a clean antecedent, and a similarly situated co‑accused had already been granted bail. The court examined these contentions, noted the lack of a specific charge against the petitioner and the precedent of bail to the co‑accused, and consequently ordered his release on bail with a bond of Rs.10,000 and two sureties, subject to standard conditions. The bail order also directed the lower court to verify the petitioner’s criminal antecedent and to cancel bail if conditions are breached.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious charges under the BNS Act and Arms Act
  • Whether the absence of a specific allegation against the petitioner warrants bail
  • Whether the petitioner’s clean antecedent and the bail granted to a co‑accused influence the bail decision
