Patna High Court

Sudama Kumar @ Sudama YadavversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Bail was denied to the petitioner.

Summary

The petitioner, Sudama Kumar, applied for bail in a case (Sasaram PS Case No. 630 of 2025) under Section 103(1) of the Bharatiya Nyaya Sanhita, 2023, alleging he inflicted a lathi blow on the informant's mother, causing her death. The petitioner claimed innocence, lack of eyewitnesses, and that the post‑mortem showed only a minor injury, attributing death to old age, and highlighted his clean record and custody since August 2025. The State opposed bail, emphasizing the direct allegation of a lethal assault corroborated by the post‑mortem report. The court considered the seriousness of the allegation and the presence of direct evidence linking the petitioner to the death. Consequently, the court declined to grant bail, rejecting the petitioner's application.

Issues considered

  • Whether bail should be granted to the accused in a homicide case under Section 103(1) of the Bharatiya Nyaya Sanhita, 2023 given the direct allegation of causing death.
  • Whether the absence of eyewitnesses and the petitioner's clean record warrant bail despite the post‑mortem findings.
