Holding
The court granted bail to the petitioner, subject to a bond of Rs.10,000 and two sureties.
Summary
The petitioner, Randhir Kumar Lalu, was arrested in connection with a case alleging that 842.25 litres of country-made liquor were seized from two vehicles and that he was involved in offences under Sections 272 and 273 of the Bihar Narcotic Substances Act and Section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2022. He contended that he was falsely implicated, had no ownership or possession of the vehicles, and had been in custody since 15 May 2026. The State opposed his bail application. The court examined the submissions and, finding no sufficient ground to deny bail, ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties of the same amount, subject to the satisfaction of the Special Judge Excise‑II, Samastipur. The order effectively granted bail to the petitioner.
Issues considered
- What is the appropriate decision on the petitioner's bail application in light of the alleged offences under Sections 272, 273 of the BNS and Section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2022?
- Whether the petitioner’s claim of false implication and lack of ownership/possession of the seized vehicles warrants granting bail?
