Decided

BAIL GRANTED

Holding

The Court granted bail to the petitioner, directing the furnishing of a bail bond with two sureties.

Summary

Vijay Yadav was arrested in connection with a case registered under Sections 137, 96 and 64(1) of the Bihar Negotiable Securities Act and Sections 4 and 6 of the Protection of Children from Sexual Offences (POCSO) Act, alleging abduction and sexual relationship with a minor. The petitioner claimed innocence, asserting that the victim voluntarily left her home, as reflected in her statement. He applied for bail after being in custody since 7 January 2026. The learned counsel for the State opposed the bail, while the petitioner's counsel argued lack of incriminating evidence. The Court, after hearing both sides, allowed the bail application, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties of equal amount. Consequently, the petitioner was released on bail pending trial.
