BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners subject to conditions under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.

Summary

The petitioners, five residents of Rashidpur, sought anticipatory bail fearing arrest in a case registered under multiple IPC sections for a vehicular incident that resulted in a death and subsequent village protest. The informant reported that a vehicle had struck a person, leading to villagers assaulting the driver and police, after which the accused allegedly turned violent towards police. The FIR named ten accused and 20‑25 unknown persons, but the petitioners argued that no specific overt act was attributed to them, noting they are relatives of the deceased. They also highlighted that similarly situated co‑accused had been granted anticipatory bail in a prior order (Cr.Misc. No. 72145 of 2025). The State opposed the bail, but the Court, applying Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023, ordered that the petitioners be released on bail if they surrender within eight weeks, subject to a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether anticipatory bail can be granted to the petitioners under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023 despite the FIR containing general allegations.
  • Whether the lack of specific overt acts against the petitioners justifies bail.
