Holding
The Court conditionally granted provisional anticipatory bail to the petitioner, subject to verification of his criminal antecedent and compliance with bail bond conditions.
Summary
The petitioner, Amit Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, involving alleged recovery of 3,335.4 litres of liquor from a truck. He argued that he was not arrested on the spot, had no possession of the liquor, was not the vehicle owner, and was implicated solely on a confessional statement of another accused, which he claimed lacks evidentiary value. The State opposed the bail. The High Court, considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.20,000 with two sureties and a condition that the trial court verify the petitioner’s criminal antecedent; if more than four prior cases are found, the bail will not be confirmed, otherwise it will be confirmed. The petitioner was also directed to deposit Rs.5,000 with the Patna High Court Advocate Association. The order was made under Section 438(2) of the Cr.P.C. and Section 482(2) of the BNSS.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 438 of the Cr.P.C. given the nature of the alleged offence and his criminal antecedent.
- Whether the confessional statement of another accused provides sufficient basis for arrest in an excise case.
