The court held that anticipatory bail may be granted subject to conditions under Section 438(2) of the Criminal Procedure Code.

Summary

Petitioner Raviranjan Ray sought anticipatory bail fearing arrest in a case under IPC sections 272, 273 and 34 and Section 30(a) of the Bihar Prohibition and Excise Act, alleging that liquor was seized from a vehicle not owned by him and that his mobile number was used by a friend to commit the alleged offence. He argued that he was not arrested on the spot, had no conscious possession of the liquor, and was unaware of the misuse of his phone. The State opposed the bail. The High Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.15,000, two sureties of equal amount, and verification of his criminal antecedents, invoking Section 438(2) of the Cr.P.C. The order also stipulated that if more than three prior cases are found, the bail would not be confirmed. The application was allowed.
