Holding

The Court permitted the withdrawal of the anticipatory bail application and dismissed it as withdrawn.

Summary

The petitioner, Bhojpuriya Devi, filed an anticipatory bail application in Criminal Miscellaneous No. 4401 of 2026 before the Patna High Court. After hearing, the petitioner’s counsel sought the Court’s permission to withdraw that application. The Court granted the permission, dismissed the anticipatory bail application as withdrawn, and ordered that the petitioner surrender before the subordinate court within eight weeks. The Court further directed that the petitioner may then file a regular bail application, which the lower court shall consider on its merits. The order clarified that the earlier order rejecting anticipatory bail on 20.12.2024 will not prejudice any future regular bail application.

  • Whether the lower court can entertain a regular bail application without prejudice to an earlier rejection of anticipatory bail
