Patna High Court

Aditya RajversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioners.

Summary

The petitioners, Aditya Raj and Devdatt Kumar, were arrested in connection with an Excise case (PS No. 205 of 2025) for alleged possession of 546.840 liters of foreign liquor recovered from bushes, alleged under Section 30(a) of the Bihar Prohibition and Excise Act. They contended that they were falsely implicated, that no incriminating material was found in their possession, and that the liquor was recovered from an open area accessible to all. The State opposed bail, while the petitioners highlighted the lack of compliance with Section 103 of the BNSS, 2023 and the fact that one petitioner had a prior criminal antecedent while the other did not. Considering the circumstances, the Court found no compelling reason to keep them in custody and ordered bail. The petitioners were released on bail upon furnishing a bond of Rs.15,000 each with two sureties of the same amount.
