Patna High Court

Kunal Kumar SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner as the recovery did not prima facie establish his possession.

Summary

The petitioner, Kunal Kumar Singh, was named in an FIR under Section 30(a) of the Bihar Prohibition and Excise Act for alleged illegal manufacture and trade of illicit liquor, with 7.020 liters recovered from his dhaba and 40,125 liters from a bullet motorcycle. He contended that the liquor was not in his conscious physical possession, that the dhaba was open to the public, and that the motorcycle did not belong to him, asserting a clean antecedent. The State opposed his prayer for anticipatory bail. The Court examined the factual submissions and noted that the recovery did not prima facie establish possession by the petitioner. Consequently, the Court directed that the petitioner be released on anticipatory bail, subject to a bail bond of Rs.10,000 with two sureties and conditions under Section 438(2) of the CrPC and Section 482(2) of the BNSS Act.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438 CrPC in view of the alleged recovery of illicit liquor.
  • Whether the recovery of liquor from the dhaba and motorcycle constitutes conscious physical possession of the petitioner.
