Patna High Court

Md. AzadversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court modified the bail order to correct the father's name in the cause title.

Summary

The petitioner, Md. Azad, had been granted bail by the Patna High Court on 27 January 2026. He later discovered that the cause title of the bail order incorrectly listed his father's name as 'S/O Jasina Khatun' instead of the correct 'S/O Md. Rafique @ Rafeeq Shaikh'. The petitioner, through counsel, filed an application seeking rectification of this typographical error. The Court examined the records and found that the mistake originated from the Stamp Reporting Section while drafting the cause title. Consequently, the Court ordered that the father's name be corrected in the cause title of the bail order and modified the order to reflect this change. The Office was directed to implement the correction.

27.01.2026 passed in the present case. It is further submitted

that the father’s name of the petitioner has been wrongly

mentioned as ‘S/O Jasina Khatun’ in place of ‘S/O Md. Rafique

@ Rafeeq Shaikh’ in the cause title of the said order, although it

error has crept in due to a typographical mistake made by the

Stamp Reporting Section while creating the cause title and as
