Holding
The petitioners are entitled to bail and must be released upon furnishing the prescribed bond and sureties.
Summary
The petitioners, Rajendra Kumar and Kundan Kumar, were arrested in connection with a murder case (Malsalami PS Case No. 563 of 2024) and charged under Sections 103 and 3(5) of the B.N.S. 2023. They argued that they were falsely implicated, not named in the FIR, and that the only evidence against them was a confessional statement that did not lead to recovery. The prosecution opposed bail, citing the seriousness of the offences. The court examined the lack of direct incriminating material and the fact that a co‑accused had already been granted bail. Considering these circumstances, the court ordered that both petitioners be released on bail upon furnishing a bond of Rs. 10,000 with two sureties, thereby disposing of the bail petitions.
Issues considered
- Whether bail should be granted to the petitioners under Sections 103 and 3(5) of the B.N.S. 2023 in the absence of direct incriminating evidence.
- Whether the petitioners were properly implicated in the FIR and whether the prosecution’s case warrants continued detention.
