DISPOSED

Holding

The court granted provisional anticipatory bail to the petitioner, subject to verification of his antecedents and compliance with the conditions under Section 482(2) of the B.N.S.S.

Summary

Ram Babu Mahto was implicated in a case under Sections 30(a) and 32(2) of the Bihar Prohibition and Excise (Amendment) Act, 2022 for alleged recovery of 144.195 litres of liquor from three vehicles and a sack. The petitioner argued that he was not arrested at the spot, that the liquor was not found in his possession, and that he was unaware that his motorcycle was misused by a third‑person, Dheeraj. He also highlighted his antecedent of three prior excise cases, contending that this did not warrant denial of bail. The State opposed the grant of anticipatory bail. The High Court, after considering the submissions, ordered provisional anticipatory bail subject to a bond of Rs.15,000 and two sureties, and directed the trial court to verify the petitioner’s criminal antecedents; if more than three cases are found, the bail would not be confirmed, otherwise it would be confirmed. The order was made under Section 482(2) of the B.N.S.S. and the provisions of the Bihar Prohibition and Excise Act.
