The court granted provisional anticipatory bail to the petitioner subject to bail bond conditions and verification of his criminal antecedent.

Summary

Vikash Kumar was accused of an offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, involving alleged recovery of 600 litres of liquor near the Ganga River. He argued that he was not arrested at the spot, had no possession of the liquor, and was implicated mechanically by a chaukidar. The petitioner, who has six prior criminal cases (four under the Excise Act), sought anticipatory bail. The court, considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.30,000 with two sureties and a condition to verify his antecedent; if more than six prior cases are found, the bail would not be confirmed. The petitioner also agreed to deposit Rs.5,000 with the Patna High Court Advocate Association.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 of the Cr.P.C.
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail
  • Whether the alleged facts constitute a cognizable offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022
