Patna High Court

Ankur Kumar Sharma @ Ankur KumarversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The Court denied the petitioner's regular bail application.

Summary

The petitioner, a student named Ankur Kumar Sharma, applied for regular bail in a case involving multiple offences under the Bihar Negotiable Substances Act, 2023, including sections 126(2), 115(2), 127(2), 125, 109, 140(1), 117(2), 61(2) and 3(5). He had been in custody since 1 November 2025 and had three prior criminal cases. The petitioner argued that earlier bail applications by other individuals in similar circumstances had been granted and that the allegations against him were general. The State contended that, given his antecedent serious cases, granting bail could lead to his absconding. After hearing both sides, the Court declined to grant regular bail, noting the risk of absconding, but allowed the petitioner to re‑apply for bail after the charge‑framing stage.

Issues considered

  • Whether regular bail should be granted to the petitioner despite his antecedent criminal cases and the risk of absconding
  • Whether the nature of the allegations under the B.N.S., 2023 justifies denial of bail

Subjects

  • bail
  • regular bail
  • anticipatory bail
  • criminal procedure
  • antecedent cases
  • risk of absconding
  • Bihar Negotiable Substances Act
